This is correct in my experience. I filed SARs quarterly in my support years, customers trying this exact path. We had a template: "hardware asset records are processed under legitimate interest for service provision, not as personal data attributable to data subject." Fritz48, you may get service metadata, IP logs, ticket history. Disk vendor invoice? Unlikely. The chargeback partial was your real win here.

Same thing here in SP, I bought dedicated from a local reseller, "enterprise" too, died in 5 months. They also said "uso residencial" even I pay business invoice. Now I build my own colocation at a datacenter in Barueri, is more expensive but I control the hardware. CloudCone price is joke, you know is joke when you pay, you just hope you are lucky. I was not lucky.

The latency from Melbourne to CloudCone LA is 170ms minimum. For $15 I would expect that, but the thread drift to "is it worth it" misses the point. @Fritz48's logs show 99.97% weeks 1-12, that is not bad network or DC, that is specifically storage substandard. I have mtr to their LA IP from three vantage points, no packet loss, stable routing via Telstra. The problem is not the network. The problem is what they bolted to it.

I am on their $3.50 VPS plan, two years now. It works for a static site. The dedi offers appear sometimes in flash sales, never permanent catalog. My theory: they buy decommissioned workstation batches, no IPMI, no DRAC, just Intel AMT if you are lucky. The "fair use" language appeared in their terms around 2022, I remember because I considered a dedi then and read the whole thing. It was not there in 2020.

Partial was $31.50 of $90 remaining. My bank says merchant provided "service usage logs" showing "high write intensity." I never gave them write metrics, so CloudCone inferred from power-on hours or invented. I am appealing the partial denial. @Its6 thank you for the Article 15 framing, I will refine my request. @randyaround I was running ext4 on mdadm raid1, not ZFS, I know I know.

mdadm raid1 with identical gray-market SSDs, no hot spare, no monitoring daemon that pages you. Brother. I run ZFS on my Denver box, scrub weekly, two different drive vintages, one Seagate one WD. Not because I love chaos, because uncorrelated failure domains matter. Your setup was not wrong, it was just not enough for the risk level that $15 implies. "Fair use" is still nonsense though.

Istanbul has expensive import duties on server hardware, so we use Hetzner or OVH mostly, EU delivery. I looked at CloudCone once, the USD pricing with no lira option, plus SWIFT fee, made it silly. The "fair use" claim on SSD wear is interesting legally — in Turkey consumer law says "expected use" for electronics is minimum 2 years. They would need to prove you abnormal. 24/7 is normal for server.

Munich consumer protection says same, 2 years Gewaehrleistung. But Fritz48 is in Berlin, same country, so BGB applies. The "fair use" clause is probably AGB-Kontrolle voidable, especially with §308 BGB no unreasonable disadvantage. I am not lawyer, I just read too much. CloudCone is US company though, does BGB reach? Your contract law is probably California, no? This complicates.

Terms say "governed by laws of the State of California, United States." I know because I checked after the "fair use" reply. So BGB Gewaehrleistung does not apply directly, but my bank is German, chargeback under BGB Einwendungsdurchgriff maybe. I am still pursuing. @mattbyte3 thank you for Turkish perspective, I will cite "expected use is 24/7 for server" in my appeal.

Rotterdam, I am at Leaseweb Amsterdam actually, colo. Their cloud is overpriced but bare metal is fair. The thing about these "too cheap to be real" offers: they are real until they are not. CloudCone has been around years, they did not exit-scam, they just degrade quality at margin. I prefer honest pricing. My Leaseweb box is €89, never a disk issue, but I also pay 6x what Fritz48 paid. You choose.
